1. Guidelines on dealing with serious accidents
When a serious accident occurs, the site of the accident is visited by a labor supervisor from the Ministry of Employment and Labor (MOEL), an officer from the Korea Occupational Safety and Health Agency (KOSHA) and a police officer from the district department, to conduct basic investigation.
KOSHA sends its opinion on the accident to MOEL, where the relevant unit interrogates witnesses. MOEL then submits its final opinion to the prosecutors’ office based on its own investigation and on its examination of presence of any crime, the process of which is supervised by the prosecutors’ office. During this course, it is critically important to have a labor attorney’s opinion added to the data. Therefore, working with an experienced labor attorney would be extremely useful.
